Terms and Conditions for the “EWC25 Superfan Program” by mousesports GmbH

Preamble mousesports GmbH, Glockengiesserwall 1, 20095 Hamburg, Germany, represented by its Managing Director Stefan Wendt, registered in the Commercial Register of the Local Court of Hamburg under HRB 155250, VAT ID No.: DE323099697 (hereinafter “MOUZ” or “Organizer”), offers fans the chance to win a free trip to the Esport World Cup 2025 (EWC25) in Riyadh, Saudi Arabia (hereinafter “Prize Draw”). Participation in the Prize Draw and its execution are governed by the following provisions.

§ 1 Eligibility (1) Eligible to participate are natural persons who, at the time of participation, have reached the age of 18. (2) Excluded from participation are citizens and permanent residents of the member countries of the Gulf Cooperation Council (GCC), namely: Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, and the United Arab Emirates. (3) Furthermore, employees, freelancers, coaches, and players of MOUZ, as well as employees of affiliated companies or the EWCF (Esport World Cup Foundation) and their respective relatives, are excluded from participation. (4) Participation is free of charge and not dependent on the purchase of goods or services.

§ 2 Participation in the Prize Draw (1) Participation in the Prize Draw is effected by completely and truthfully filling out the application form. The link to the application form, which is hosted on a landing page, will be provided on the official MOUZ Discord server. (2) The participation period begins on June 11, 2025 and is scheduled to end on July 2, 2025 (hereinafter “Participation Period”). However, the Organizer reserves the right to end the Participation Period prematurely, for instance, once a predetermined number of applications (100) has been reached. The beginning, the scheduled end, and any premature closure of the Participation Period will be announced on the official MOUZ Discord server. Applications received outside the active Participation Period will not be considered. (3) By submitting the application, the participant agrees to these Terms and Conditions. (4) Each person may only participate once in the Prize Draw. Multiple participations or the provision of false information will lead to exclusion from the Prize Draw. (5) Submission of the application does not constitute a legal claim to selection or participation in the “EWC25 Superfan Program.”

§ 3 Winners Selection, Notification, and Confirmation (1) After the end of the Participation Period, MOUZ will select a limited number of winners (hereinafter “Club Superfans”) from all valid participants. The selection will be based on the criteria set out on the official MOUZ Discord server or, if so stated there, by a random draw among all qualified entries. (2) The Club Superfans will be notified by MOUZ via email or direct message on Discord. (3) The Club Superfans must confirm acceptance of the prize to MOUZ via email or Discord direct message within five (5) calendar days of receiving the notification. If no confirmation is received within this period, the claim to the prize will be forfeited without replacement, and MOUZ is entitled to select a new Club Superfan. (4) After the general acceptance of the prize, MOUZ may invite the Club Superfan to one or more online meetings (calls) with a designated representative to finalize travel arrangements and confirm the Club Superfan’s serious intention to participate. Participation in these meetings is a prerequisite for the final commencement of the trip. (5) A binding contract regarding the travel service between the Club Superfan and MOUZ shall only come into effect upon receipt by MOUZ of the Club Superfan’s final acceptance confirmation following the meetings mentioned in para. 4. (6) Legal recourse regarding the execution of the selection process and the awarding of the prize is not excluded insofar as it concerns the review of the proper execution of the Prize Draw according to the announced criteria.

§ 4 Prize: EWC25 Superfan Package Services (1) MOUZ will organize and book the following services for the Club Superfans (hereinafter “EWC25 Superfan Package Services”): a) One round-trip flight in economy class to Riyadh from a major international airport reasonably close to the Club Superfan’s residence, as determined by MOUZ. b) One (1) EWC25 weekly ticket (access to the EWC Festival and all matches from Thursday to Sunday with regular seating during the week specified on the official MOUZ Discord server). c) Five (5) nights’ accommodation in a 3 to 4-star hotel in Riyadh selected by MOUZ (check-in on Wednesday, check-out on Monday during the week specified on the official MOUZ Discord server). d) Shuttle service between the hotel/esports arena and between the hotel/airport for participation in the EWC25. (2) The EWC25 Superfan Package Services are strictly limited to the travel dates and departure/arrival locations specified by MOUZ. The Club Superfan will be provided with all relevant booking information. (3) A prerequisite for commencing the trip is the issuance of a tourist visa for the Kingdom of Saudi Arabia for the Club Superfan. The visa process will be coordinated by a MOUZ representative, and MOUZ will cover the costs for a visa application service. However, the Club Superfan is solely responsible for ensuring they meet the eligibility criteria for a tourist visa to the Kingdom of Saudi Arabia based on their nationality and personal circumstances. MOUZ is not liable if a visa is denied for reasons attributable to the participant and does not guarantee the issuance of the visa. The responsibility for providing all necessary and correct documents for the visa application in a timely manner lies with the Club Superfan. (4) No cash alternatives, changes, or substitute services will be offered. (5) For the avoidance of doubt, costs for meals, food and beverages, personal expenses, travel insurance, and any other services not expressly listed in §4 para. 1 are not included in the prize and are the sole responsibility of the Club Superfan. (6) The prize is non-transferable. (7) MOUZ is entitled to commission third parties (e.g., travel agencies) to fulfill its obligations. MOUZ does not act as a tour operator.

§ 5 Forfeiture of Prize and New Draw MOUZ reserves the right to allocate the EWC25 Superfan Package Services to another participant if the originally selected Club Superfan, despite proper notification, does not provide the data or documents required for the visa application and travel booking in a timely manner, does not participate in or refuses to participate in the coordination meetings mentioned in § 3 para. 4, is denied a tourist visa for the Kingdom of Saudi Arabia, or if such a visa is revoked.

§ 6 Obligations of the Club Superfan and Costs for Non-Appearance (1) With the final confirmation of acceptance of the prize and the trip (especially after the conclusion of the coordination meetings mentioned in § 3 para. 4 and after flight booking by MOUZ), the Club Superfan makes a binding commitment to undertake the trip. (2) The Club Superfan is obliged to provide MOUZ with all information and documents necessary for booking and carrying out the trip punctually and correctly, and to actively participate in all necessary coordination processes. (3) Costs for Non-Appearance for the Trip: Should the Club Superfan, after making a binding commitment according to para. 1 and after flights have been booked by MOUZ, fail to undertake the trip for reasons for which they are responsible (in particular, by not appearing at the airport on the day of departure at the specified time), MOUZ reserves the right to charge the Club Superfan liquidated damages amounting to 50% of the flight costs booked and paid by MOUZ for the Club Superfan. The Club Superfan will be informed of the amount of the booked flight costs as soon as these are determined. The Club Superfan is expressly permitted to prove that MOUZ incurred no damage or significantly less damage than the flat-rate amount. (4) Reasons for which the Club Superfan is not responsible include, in particular, a medically certified inability to travel which demonstrably makes the trip impossible for them, or other circumstances of force majeure which objectively prevent the commencement of the trip. The Club Superfan is obliged to inform MOUZ immediately of the existence of such reasons and to provide proof. (5) MOUZ strongly recommends that the Club Superfan takes out private travel cancellation insurance that may cover possible cancellation or non-appearance costs.

§ 7 Data Protection (1) The Controller for the processing of personal data within the scope of this Prize Draw is mousesports GmbH, Glockengiesserwall 1, 20095 Hamburg, Germany, email: info@mousesports.com. (2) Purposes and Legal Bases of Processing: a) The processing of your personal data (e.g., name, email address, Discord username, address, date of birth, in case of winning, passport data and, if applicable, information from the coordination meetings) is carried out for the execution of the Prize Draw, in particular for the selection of the Club Superfans, their notification, for conducting the coordination meetings, and for the organization and handling of the EWC25 Superfan Package Services. The legal basis for this is Art. 6(1)(b) GDPR (performance of a contract or implementation of pre-contractual measures). b) Data Transfer to Saudi Arabia: For the organization and execution of the trip (flight, hotel, EWC25 ticket), it is necessary to transfer your personal data (in particular name, contact details, passport data) to service providers (e.g., airlines, hotels, travel agencies) and the organizer of the EWC25 (EWC Foundation) in Saudi Arabia. Saudi Arabia is a third country for which there is no adequacy decision by the EU Commission pursuant to Art. 45 GDPR. The transfer of your data will therefore only take place on the basis of your explicit consent pursuant to Art. 49(1)(a) GDPR. By consenting, you agree that your data will be transferred to a country where lower data protection standards may apply. You will be informed in detail about these risks as part of the separate consent process. This consent is voluntary and can be revoked at any time with future effect. Without your consent to the data transfer, participation in the prize or undertaking the trip is not possible. (3) Recipients or Categories of Recipients: Your data may be disclosed to the following categories of recipients: internal departments of MOUZ, technical service providers (e.g., for the application landing page), travel agencies, airlines, hotels in Saudi Arabia, and the EWC Foundation. (4) Storage Duration: Your personal data will be stored for the duration of the Prize Draw and its handling and thereafter deleted in accordance with statutory retention periods. (5) Rights of the Data Subject: You have the right to access, rectification, erasure, restriction of processing, data portability, and to object to processing, provided the legal requirements are met. (6) Right to Lodge a Complaint: You have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for MOUZ is the Hamburg Commissioner for Data Protection and Freedom of Information. (7) Obtaining Consents: Required consents, in particular for data transfer to Saudi Arabia and for the publication of winners data, will be obtained separately from the agreement to these Terms and Conditions.

§ 8 Publication of Winners Data (1) MOUZ intends to publish the name and/or social media alias or Discord username of the Club Superfan on the official MOUZ Discord server, the MOUZ website, and official MOUZ social media channels @mousesports on X, Facebook and Instagram for the purpose of announcing the winners. (2) This publication will only occur with your explicit, separate consent. This consent is voluntary and not a prerequisite for participation in the Prize Draw. (3) The consent will specify what data will be published, where, and for how long. (4) You have the right to revoke your consent at any time with future effect by sending an email to info@mousesports.com.

§ 9 Content Creation and Grant of Rights (1) By accepting the prize, the Club Superfan acknowledges and agrees that their participation in the trip is as a brand ambassador for MOUZ. As an integral part of the prize, the Club Superfan agrees to participate in good faith in reasonable photo, video, and audio recordings and interviews (collectively, “Content”) created by MOUZ or its designated agents during the trip in Riyadh. (2) For this purpose, the Club Superfan grants MOUZ the non-exclusive, royalty-free, transferable, sub-licensable, and worldwide right, for a period of ten (10) years, to use, reproduce, distribute, and publicly display the Content in which the Club Superfan appears. This includes the right to edit the Content and to use it, in whole or in part, for promotional, marketing, and public relations purposes in any and all media, including, without limitation, on the official MOUZ website, social media channels, and YouTube. (3) This grant of rights includes the personality rights of the Club Superfan, especially the right to their own image. The Club Superfan is aware that they can revoke this consent at any time with future effect by sending an email to info@mousesports.com. In the event of revocation, MOUZ will not create or publish any new Content featuring the Club Superfan but may not be able to remove Content that has already been published.

§ 10 Premature Termination of the Prize Draw MOUZ reserves the right to terminate or interrupt the Prize Draw at any time for good cause without prior notice. A good cause exists in particular if, for technical or legal reasons, the proper execution of the Prize Draw can no longer be guaranteed.

§ 11 Liability (1) MOUZ shall be liable without limitation for damages resulting from injury to life, body, or health which are based on an intentional or negligent breach of duty by MOUZ or its legal representatives or vicarious agents. (2) For other damages, MOUZ shall be liable without limitation only in cases of intent and gross negligence. For a breach of essential contractual obligations (cardinal duties) due to slight negligence, liability shall be limited to the foreseeable, typically occurring damage. (3) Essential contractual obligations are those obligations the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the participant regularly relies. (4) Any further liability for slight negligence is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 12 Applicable Law and Jurisdiction (1) These Terms and Conditions and the entire legal relationship between the participants and MOUZ shall be governed exclusively by the laws of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). (2) To the extent legally permissible, Hamburg, Germany, is agreed as the place of jurisdiction. For consumers, mandatory consumer protection regulations of their country of residence may take precedence.

§ 13 Information on Online Dispute Resolution for Consumers The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. MOUZ is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. This information is usually provided in the legal notice or imprint of a website, if one exists.

§ 14 Severability Clause Should individual provisions of these Terms and Conditions be or become invalid or void, or contain a loophole, the validity of the remaining provisions shall remain unaffected. In place of the invalid or void provision, the valid provision that comes closest to the economic intent and purpose of the original provision shall be deemed agreed. The same shall apply in the event of a loophole.
